Please read these Terms before using BitKing (the "Game"). By downloading, installing or using the Game you agree to these Terms. The Game is developed and published by TAP WATER LIMITED ("we", "us").
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on Apple devices you own or control, for personal non-commercial entertainment only. You may not reverse engineer, decompile, disassemble, modify, rent, lease, lend, sell, sublicense or distribute the Game, nor use cheats, modifications or any other means to interfere with the Game or gain an unfair advantage.
2. Accounts and connectivity
The Game has no account system: no registration or sign-in is required, and no internet connection is needed to play (other than for purchases, which are handled by Apple). The Game has no social features, chat, friends list or leaderboards, and does not allow users to upload or publish any content. All opponents are computer-controlled.
3. In-app purchases
- The Game offers consumable in-app purchases (in-game diamonds) only. There are no subscriptions, no auto-renewal and no non-consumable items.
- All transactions are processed by Apple's App Store. Prices and currency are shown by the App Store for your region; the amount shown at checkout governs.
- Diamonds and other virtual items may be used only inside the Game. They have no real-world monetary value, cannot be exchanged for money or property, and cannot be transferred, gifted or traded outside the Game.
- Consumable items are deemed delivered once granted. Refunds are governed by Apple's policies and must be requested from Apple.
- We may change item prices, contents or game balance. Items already purchased and granted are not retroactively adjusted.
4. Game data
Progress is stored only in local storage on your device; we keep no copy. Deleting the Game, clearing its data, switching devices or device failure will permanently and irrecoverably erase your progress, including virtual items you have purchased. The Game has no cloud save.
5. Intellectual property
The Game and all of its content (including software, art, music, text and design) are owned by us or our licensors and protected by law. These Terms transfer no intellectual property rights.
6. Disclaimer and limitation of liability
The Game is provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of or inability to use the Game, and our total liability shall not exceed the amount you actually paid to Apple for the Game in the preceding twelve months.
7. Changes and termination
We may update these Terms from time to time; updated Terms take effect when published on this page. If you do not agree, stop using and delete the Game. We may terminate your licence if you breach these Terms.
8. Relationship with Apple
These Terms are between you and us only, and not with Apple Inc. Apple is not responsible for the Game or its content and has no obligation to furnish any maintenance or support services for the Game. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as such.
